 Here is the second phase of my jurisdictional challenge — if they somehow come up with proof of authority to enforce Section B of the Transportation Code. This one is for their lack of primary pleadings.

then you should SAY "no primary pleadings"; don't say "no valid complaint".


i went back and took a better look after dinner, and i'd like to ask why you're citing Huynh and perpetuating the false notion that a corporation court gets to commence a criminal action by a complaint instead of holding their feet to the fire of what the Texas Constitution (and current statutes) clearly require: primary pleadings: an indictment or an information (with the supporting sworn complaint filed alongside).

Could you elaborate more on this? I know they will reason that the complaint is a valid “charging instrument”. Huynh seems to cover this exactly so this is likely to come up (if they are somewhat competent).

There’s certainly potential for Huynh to come up. I looked into this a while back and found cases relevant to your matter where Huynh was mentioned. These were all cases after the 1999 repeal of 45.01. Brett disagrees with me on this and that’s fine but you’ll have to make up your own mind.  Prepare for battle, my friend!

Not dislplaying a plate is not an arrestable offense and yes, I need them to cite me for it so that I can immediately go right back after them them with criminal complaints i already have made up, then sue the magistrates when they faile to properly act on the complaints as the law specifically commands.  Dr. Graves, when I went into combat, I swore to protect this country from all enemies, foreign and  domestic.  I found an enemy and it is domestic.  This is my job in accordance with my sworn oath.


should I duck and run for cover just because some jackass with a gun frowns at me?  I am a citizen in a republic and my public officials answer to me.  I may or may not like their answers, but they will answer. 
I am in the process of fixing something I believe to be wrong that is hurting my fellow citizens and I intend to fix it. 
When I went to combat, I did not condition combat on what was easy or convenient.  I am still bound by that oath and know more than many to potential consequences: three dislocated ribs, two bronken collar bones, broken elbow, a tooth knocked out, sentenced to a year in jail and more arrests than I remember.
In the overall scheme of things, they pale into insignificance before the price my brother and many others paid. 
With that  said, I do not advocate that others do this.  I am old.  Heck @TheJurisdictionary I am almost as old as you.  My mortgage is paid off, no credit cards, not debts, my kids are grown.  No one depends on me for their livelihood. 
I also have a special motivation. 
  If someone is not in this  position, it would not be prudent to put those who depend on you in this type of situation.   I do not suggest they do what I do. 
But, at some point, as a citizen in a republic, you just have to say, "No MaS."

I find it interesting you are an attorney, you should know peoples rights are being violated and law misapplied, but you dont seem to care or defend the rights of people to TRAVEL. Eddie Craig has been proving the system is nothing but policing for profit and you talk about Randy only getting to the heart of this problem if he is in CUSTODY... According to AI, the courts always use Stare Decisis (basically case precident) to defeat most cases, referencing the 1915 Kendrick case (which says driving is a privilege) - and it works because the word "privilege" is not a legal word and has never been properly defined, so when anyone tries to challenge it, they use case precedent to bypass any arguments.

How will you go about fighting that?
