INSTRUCTIONS: You are hereby given formal NOTICE under the principles of good faith and fair dealing to respond to the following lawful and factual inquiries under penalty of perjury. Your full, complete, and truthful response is requested within ten (10) business days. Failure to respond will constitute admission and agreement by estoppel.

SECTION I: PUBLIC OATH, AUTHORITY & ROLE

  1. Do you admit or deny that you, Lt. Timothy P. Faranda, have taken a sworn oath to uphold the Constitution of the United States and the Constitution of the State of New Jersey?

  2. Do you admit or deny that all sworn law enforcement officers, including Sgt. Anthony Mazza, have a fiduciary duty to the public, including private citizens, under their oath of office?

  3. Do you admit or deny that the oath you swore binds you to uphold the unalienable rights of private citizens, including Naomi Johnson?

  4. Do you admit or deny that police officers are not authorized under the Constitution to enforce civil administrative codes, statutes, or policies as if they were criminal laws?

  5. Do you admit or deny that police officers acting to issue traffic citations without judicial authorization may be acting as policy enforcers and/or revenue agents?

  6. Do you admit or deny that you are required to maintain impartiality, fairness, and equal protection under the law in your duties?

SECTION II: ADA & DUTY OF ACCOMMODATION

  1. Do you admit or deny that the Americans with Disabilities Act (ADA) requires law enforcement officers to reasonably accommodate known disabilities during an encounter with a disabled person?

  2. Do you admit or deny that Naomi Johnson had previously provided medical documentation of disability and was visibly disabled on the date of the stop?

  3. Do you admit or deny that Sgt. Mazza failed to offer reasonable accommodations, including failing to ensure Naomi had a safe means of transportation after towing her vehicle?

  4. Do you admit or deny that Sgt. Mazza’s conduct constituted neglect of duty and possible ADA violation under Title II of the ADA and Section 504 of the Rehabilitation Act?

SECTION III: TOWING, WARRANT, AND JURISDICTION

  1. Do you admit or deny that a warrant issued by a judicial officer is required to lawfully seize private property such as a private automobile not involved in a criminal act?

  2. Do you admit or deny that no judicial warrant was issued authorizing the towing of Naomi Johnson’s private automobile?

  3. Do you admit or deny that probable cause is required only in the event of a suspected criminal act?

  4. Do you admit or deny that a traffic citation, as issued to Naomi Johnson, is a civil or administrative infraction and not a criminal offense?

  5. Do you admit or deny that civil and administrative violations do not authorize the suspension of constitutional rights?

  6. Do you admit or deny that under the New Jersey Predatory Towing Prevention Act, certain notice, signage, and lawful processes must be followed before towing any vehicle?

  7. Do you admit or deny that Glen Ridge does not have written published procedures for towing private automobiles not registered under the commercial code?

  8. Do you admit or deny that your department’s towing policy applies to motor vehicles defined under Title 39 and not to private automobiles or conveyances outside commercial registration?

SECTION IV: MISIDENTIFICATION & DISCRIMINATION

  1. Do you admit or deny that the traffic citation issued by Sgt. Mazza identified Jane Doe’s race as "Black"?

  2. Do you admit or deny that racial classification by skin color is not a legal ethnicity or nationality but may amount to false labeling?

  3. Do you admit or deny that your department uses race labels on traffic citations as standard procedure for all stops?

  4. Do you admit or deny that no law mandates a private woman or man to identify themselves unless there is articulable suspicion of a crime?

  5. Do you admit or deny that demanding identification during a civil or administrative stop may be a constitutional violation absent reasonable, articulable suspicion?

  6. Do you admit or deny that requiring identification without criminal suspicion violates Terry v. Ohio and Fourth Amendment protections?

SECTION V: EMERGENCY EQUIPMENT AND PROCEDURE

  1. Do you admit or deny that activating sirens or emergency lights must be supported by law or emergency protocol?

  2. Do you admit or deny that activating emergency lights and sirens to effectuate a civil traffic stop is outside the lawful scope of police authority when no emergency exists?

  3. Do you admit or deny that misusing emergency signals for routine civil stops may violate internal policy and public trust?

SECTION VI: VIDEO EVIDENCE & DUE PROCESS

  1. Do you admit or deny that Naomi Johnson has a legal right to request and obtain the body-worn camera footage of Sgt. Mazza’s stop?

  2. Do you admit or deny that the bodycam footage requested under the OPRA and/or ADA for defense in a tort claim has not yet been provided?

  3. Do you admit or deny that you have requested Naomi Johnson’s private media without a subpoena, court order, or reciprocal discovery obligation?
