I. Statement of Status and Purpose
I, Jane Doe, a private woman, natural person, and non-corporate living being domiciled in the State of New Jersey, present this lawful and good-faith Notice for Admission and Clarification of Duties. This notice is intended to secure lawful transparency and truth regarding the actions of Sgt. Anthony Mazza and the Glen Ridge Police Department.
This communication is made under my unalienable rights protected by:
The New Jersey Constitution, Article I, Paragraph 1
The United States Constitution, including the First, Fourth, Fifth, Ninth, Tenth, and Fourteenth Amendments
The Americans with Disabilities Act (ADA), 42 U.S.C. § 12132
The Predatory Towing Prevention Act, N.J.S.A. 56:13-7 et seq.
And Title 42 U.S.C. §§ 1983, 1985, and 241–242
II. LAWFUL QUESTIONS & DEMANDS FOR ADMISSION
You are hereby required to respond in writing to the following honest, fact-based, truth-seeking questions within ten (10) business days:
Constitutional Oath, Jurisdiction, and Authority
Do you admit or deny that public officers in New Jersey are sworn by oath to uphold only the New Jersey Constitution and the United States Constitution, not departmental policies or administrative codes that conflict with either?
Do you admit or deny that the U.S. Constitution is the supreme law of the land, and that no municipal statute or traffic code can override constitutionally protected rights?
Do you admit or deny that enforcing traffic citations on private individuals traveling in private automobiles, without evidence of harm or contract, does not derive authority from the Constitution?
Do you admit or deny that police officers engaged in the issuance of civil citations and vehicle seizures are acting as policy enforcement officers, not constitutional peace officers?
Due Process, Warrants & Probable Cause
Do you admit or deny that the seizure or towing of private property requires a judicial warrant, unless supported by exigent circumstances or a crime in progress?
Do you admit or deny that no judicial judge issued a warrant to Sgt. Mazza or any other officer to seize Naomi Johnson’s private automobile on February 24, 2025?
Do you admit or deny that probable cause under the Fourth Amendment is reserved for criminal offenses, not civil or administrative violations?
Do you admit or deny that a traffic citation is a civil or administrative code violation, not a crime under New Jersey or federal law?
Do you admit or deny that civil infractions do not provide authority to seize private property without a warrant, court order, or judicial due process?
Use of Emergency Equipment and Traffic Stop Procedure
Do you admit or deny that activating emergency lights or silent sirens in the absence of an emergency violates public trust and may constitute unlawful use of public resources?
Do you admit or deny that emergency lights and sirens are intended for true emergencies and criminal acts, not administrative code enforcement?
Do you admit or deny that Sgt. Mazza did not advise Naomi Johnson of her right to contest the traffic stop before towing her vehicle?
Do you admit or deny that no signed order from a judge was present at the time of the seizure of Naomi Johnson’s automobile?
Towing Law & Predatory Towing Prevention Act (PTPA)
Do you admit or deny that towing of a private automobile without notice, warrant, or judicial oversight may violate the New Jersey Predatory Towing Prevention Act (N.J.S.A. 56:13-7 et seq.)?
Do you admit or deny that the Glen Ridge Police Department did not provide Naomi Johnson any written documentation at the scene justifying the tow or explaining her legal options?
Do you admit or deny that no hazard, accident, obstruction, or emergency condition existed at the time her vehicle was seized?
Do you admit or deny that under the Constitution, a private woman who has committed no crime cannot have her property lawfully seized without judicial process?
Accountability and Officer Training
Do you admit or deny that you, as Lieutenant, are responsible for ensuring that all officers under your command—including Sgt. Mazza—are trained in ADA compliance, due process, and constitutional limits on government authority?
Do you admit or deny that failure to train, supervise, or correct violations of federal civil rights may constitute deliberate indifference under Monell v. Department of Social Services and 42 U.S.C. § 1983?
Please identify all training materials and dates of instruction relating to:
ADA compliance during traffic stops
Lawful towing authority
Use of force and seizure standards
Constitutional rights of private citizens
Racial Identification, Identity, and Due Process
Do you admit or deny that Sgt. Anthony Mazza labeled Jane Doe’s "race" as Black on the citation, without her consent, self-identification, or legal necessity?
Do you admit or deny that "Black" is a color and not a lawful race, nationality, or ethnicity as defined under the Constitution or statutory law?
Do you admit or deny that assigning racial designations without formal request or necessity may violate the Equal Protection Clause under the Fourteenth Amendment?
Please provide the Glen Ridge Police Department’s written policy on recording race on citations, including whether this practice is mandatory, discretionary, or optional.
Identification & Legal Threshold for Demand
Do you admit or deny that a police officer must have reasonable articulable suspicion of criminal activity before demanding a private individual’s name or identification?
Do you admit or deny that Jane Doe was not suspected of a crime nor under probable cause for criminal activity during the February 24, 2025 stop?
Do you admit or deny that demanding identification during a civil administrative stop without probable cause constitutes a violation of due process and an act under color of law?
Do you admit or deny that traffic infractions do not lawfully justify compelled identification from a private woman unless a lawful arrest based on criminal conduct is being executed?
III. Reservation of Rights & Demand for Response
I, Naomi Johnson, reserve all natural, commercial, and constitutional rights, without prejudice, including those under UCC 1-308 and UCC 1-103.6. Failure to respond to this Notice within ten (10) business days will be treated as a non-rebuttal and tacit admission for administrative and legal purposes.
